• PRICING, SALES & LOCATION-SPECIFIC CONDITIONS
  10.1 Pricing, promotions and product availability may vary by state, region and local building code requirements (wind, snow loads, permits, inspections). Photographs are illustrative; actual products may vary. Sales tax may apply. We reserve the right to end promotions and correct pricing errors.
  10.2 For buildings wider than 30' or taller than 14' you may be required, at your expense, to provide equipment (reach lift, forklift, Genie lift, Lull, etc.) as specified by StormSafe Steel to facilitate delivery and installation. Failure to provide required equipment may delay installation and may incur additional charges.

• PRICE MATCH GUARANTEE
  11.1 Our Price Match Guarantee applies only to substantially identical steel building products from other legitimate vendors and is subject to verification. A formal, dated, written quote from the competitor is required. Verbal quotes do not qualify. The guarantee applies only to quotes submitted prior to your purchase from StormSafe Steel and to products available in the same geographic market. StormSafe Steel reserves sole discretion in determining eligibility.

• COLOR CHART & VISUAL REPRESENTATIONS
  12.1 Colors displayed on the Website are approximate. Actual finishes may vary due to monitor settings. Not all colors are available in all regions. Request physical color samples for final selection.

• INTELLECTUAL PROPERTY
  13.1 All Website content (design, text, graphics, logos, images, software, and code) is owned or licensed by StormSafe Steel and protected by intellectual property laws. You may view and print pages for personal, non-commercial use only. Any other use requires our prior written consent.
  13.2 You retain ownership of content you post, subject to the license you grant us: by posting Content you grant StormSafe Steel a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display and perform that Content in connection with operating and promoting the Services. The license terminates when you remove the Content, except where removal is not reasonably possible (backups, cached copies or legal requirements).

• INDEMNITY
  14.1 You agree to indemnify, defend and hold harmless StormSafe Steel, its officers, directors, employees, agents and affiliates from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your breach of these Terms, (b) your use of the Services, or (c) Content you submit.

• DISCLAIMERS & LIMITATION OF LIABILITY
  15.1 THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. STORMSAFE STEEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  15.2 STORMSAFE STEEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, BUSINESS INTERRUPTION OR LOSS OF DATA), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  15.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMSAFE STEEL’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO STORMSAFE STEEL FOR PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
  15.4 NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM STORMSAFE STEEL’S NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY APPLICABLE LAW.
  15.5 CONSUMER RIGHTS MAY VARY BY JURISDICTION; WHERE APPLICABLE CONSUMER PROTECTIONS CANNOT BE WAIVED BY CONTRACT.

• SEVERABILITY
  16.1 If any provision is found invalid, illegal or unenforceable, that provision will be severed and the remainder of the Terms will remain in full force.

• GOVERNING LAW & JURISDICTION
  17.1 These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. You submit to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia for any dispute arising out of or relating to these Terms, unless otherwise required by applicable law.

• WARRANTIES FROM MANUFACTURER
  18.1 Product warranties are those provided by the manufacturer(s) and, unless expressly stated otherwise in writing, are passed through to the purchaser. Warranty terms (duration, coverage, limitations) vary by manufacturer, product type, region and manufacturing facility.

• REFER-A-FRIEND PROGRAM
  19.1 StormSafe Steel may operate a referral program under terms posted on the Website. Participation is voluntary and subject to eligibility rules. Referral rewards, fulfillment timing, verification procedures, and program terms may be modified or terminated at any time at StormSafe Steel’s sole discretion. Fraudulent activity disqualifies participants. Disputes are governed by Section 17 above. The referral program terms posted to the Website govern specific program details.

• FINANCING & PAYMENT TERMS
  20.1 Financing and payment plans (if offered) are subject to credit approval and lender terms. Representative payment examples are illustrative only. Additional lender fees may apply; consult an estimator for details. StormSafe Steel is not the lender; lenders’ terms and disclosures apply.

• STRUCTURAL LIMITATIONS & INSTALLATION
  21.1 StormSafe Steel buildings are engineered to meet applicable local wind and snow loads when ordered and specified accordingly. Buildings are not designed to support point loads from cranes, hoists, mezzanines, lofts, or similar attachments unless expressly engineered and documented in writing. Consult your building specialist for permitted uses and for vendors of self-supporting kits. Improper attachments void structural warranties and may create safety hazards.

• SMS & MESSAGING TERMS
  22.1 By providing a mobile phone number and opting in, you consent to receive SMS/text messages from StormSafe Steel for informational purposes (order updates, quotes, appointment reminders, account notifications). Message frequency may vary. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out of marketing messages. We will process opt-out requests in accordance with applicable law. StormSafe Steel complies with applicable communications laws (e.g., TCPA) and will not send messages to users who have opted out.

• GENERAL PROVISIONS
  23.1 Entire Agreement: These Terms, together with the Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and StormSafe Steel concerning the subject matter herein.
  23.2 No Waiver: Our failure to enforce any right is not a waiver of that right.
  23.3 Assignment: We may assign these Terms in connection with a sale, merger or other corporate transaction. You may not assign your rights without our prior written consent except in connection with a merger or sale of substantially all of your assets.
  23.4 Headings: Headings are for convenience and do not affect interpretation.
